These Terms of Service ("Agreement") constitute a legally binding agreement between you ("User") and Results Bots™ LLC ("Company," "we," "us," or "our"), governing your access to and use of our AI software-as-a-service (SaaS) platform. By accessing or using our services, you agree to be bound by these terms.
By creating an account or accessing the platform, you represent that you are of legal age and have the authority to enter into this agreement. If you do not agree to these terms, you may not use the services.
The Company provides an AI-powered voice chatbot platform designed for automated inbound communication management. We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the platform to receive, process, and manage voice interactions for your internal business or personal purposes, subject to this Agreement. You acknowledge that the service relies on third-party telecommunications and AI model infrastructure, and its functionality is dependent on the availability and performance of such systems.
You are responsible for all activity occurring under your account. You agree:
All rights, title, and interest in and to the platform, including its software, algorithms, branding, and AI outputs generated by the service (to the extent permitted by law), remain the exclusive property of the Company. You retain ownership of the data you input, provided you grant us a license to process it to provide the service.
The parties acknowledge and agree that chargebacks and payment disputes are disruptive, costly, and stressful, and may cause material harm to the Company, including but not limited to, the impairment, loss, or suspension of credit card processing accounts, banking relationships, and other essential business services.
Consequently, if a User initiates a chargeback, payment reversal, or any other dispute of payment through their bank, payment processor, or any other means, the User shall be liable for all costs incurred by the Company in defending or processing such dispute. The User agrees to be billed for such time at the following hourly rates, rounded up to the nearest whole hour:
The Company shall maintain records of time spent on such disputes, and the User agrees that these rates represent a reasonable estimate of the Company’s actual costs in addressing payment disputes.
Plain Text CopyYou agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the platform; (b) any content, output, or material generated by the AI based on your inputs, prompts, or instructions; (c) your violation of any term of this Agreement; or (d) your violation of any third-party right, including without limitation any intellectual property, property, or privacy right. This obligation survives this Agreement and your use of the platform.
The service is provided "as is" and "as available." The Company makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the AI outputs. We disclaim all warranties, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the platform. Our total liability for any claim arising from this Agreement shall not exceed the amount paid by you to the Company in the one (1) month preceding the claim for monthly plans, or one-twelfth (1/12) of the amount paid to the Company in the one (1) year preceding the claim for yearly plans.
We reserve the right to suspend or terminate your access to the service at any time, for any reason, including violation of these terms. Upon termination, your right to use the platform ceases immediately.
This Agreement is governed by the laws of the State of Wyoming without reference to any conflict of laws principles that would require the application of the laws of any other jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement. The Parties irrevocably consent to the personal jurisdiction of the state and federal courts located in Cheyenne, Wyoming for any suit or action arising from or related to this Agreement and waives any right to object to the venue of such courts. The Parties further agree that these courts will have exclusive jurisdiction over any such suit or action initiated by either party.
We may modify these terms periodically. Continued use of the platform following the posting of updated terms constitutes acceptance of the changes.
